By downloading, installing, accessing, creating an account for, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
These Terms apply to all current and future SkillSpot-branded services offered by Mir Image Creations, LLC, and to any prior beta or earlier versions of the Service to the maximum extent permitted by law.
2. ELIGIBILITY
You must be at least 13 years of age to use the Service. If you are under 18, you represent that you have obtained permission from a parent or legal guardian.
You may not use the Service where prohibited by law.
3. LICENSE GRANT; RESERVATION OF RIGHTS

Subject to your compliance with these Terms and payment of any applicable fees, Mir Image Creations grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for personal, non-commercial purposes unless otherwise authorized in writing.

All rights not expressly granted are reserved by Mir Image Creations. Nothing in these Terms transfers ownership of the Service or any intellectual property rights to you.
4. ACCOUNTS AND SECURITY
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized access or suspected security breach.
We reserve the right to suspend, terminate, or reclaim accounts or usernames at any time to protect the Service, enforce these Terms, or comply with legal obligations.
5. YOUR RESPONSIBILITIES
You agree to:
- use the Service only for lawful purposes;
- provide accurate and truthful information where requested;
- exercise personal judgment and respect your physical limits; and
- comply with all instructions, policies, and notices applicable to the Service.
6. PROHIBITED CONDUCT
You may not, and may not permit others to:
- copy, modify, distribute, sell, rent, lease, sublicense, or create derivative works of the Service;
- reverse engineer, decompile, disassemble, or attempt to derive source code or underlying algorithms;
- scrape, harvest, or extract data at scale;
- use the Service for benchmarking, competitive analysis, or to develop or improve competing products or services;
- use the Service to train external models or systems without authorization;
- interfere with the security, integrity, or availability of the Service;
- upload content that infringes intellectual property rights or violates law;
- rely on the Service in safety-critical contexts where failure could reasonably result in personal injury or property damage.
We may determine, in our discretion, what constitutes prohibited conduct and take appropriate action, including suspension or termination.
7. SUBSCRIPTIONS, BILLING, AND MARKETPLACES
Certain features of the Service may require payment of subscription fees.
- Subscriptions are billed in advance and may automatically renew unless canceled before the renewal date.
- Fees are non-refundable except where required by law or by the policies of the applicable app marketplace.
- Taxes may apply depending on your location.
Payments, renewals, cancellations, and refunds are handled by the applicable app marketplace or payment provider. Mir Image Creations does not store payment card information. Where marketplace policies conflict with these Terms, marketplace policies control.
8. AI-GENERATED CONTENT; NO PROFESSIONAL ADVICE
The Service may provide AI-generated recommendations, insights, or outputs intended to assist with planning and self-directed improvement.
These outputs are informational and educational only and may be inaccurate, incomplete, or unsuitable for some users. The Service does not provide medical, professional, or guaranteed coaching advice.
You remain solely responsible for how you interpret and apply any information provided through the Service.
9. NO GUARANTEES; PERFORMANCE DISCLAIMER
SkillSpot provides tools and recommendations designed to support planning and consistency. SkillSpot does not guarantee any particular outcome, result, or level of performance. Results vary based on individual effort, conditions, and factors outside our control.
10. ASSUMPTION OF RISK
The Service may relate to physical activities that involve inherent risks, including injury or aggravation of existing conditions.
By using the Service, you voluntarily assume all risks associated with performing any activities referenced or suggested. If you experience pain or discomfort, stop immediately and consult a qualified professional.
11. CAMERA AND MEDIA FEATURES
Certain features may request access to your device camera when you choose to use them, such as recording movements or capturing images. Camera use is always user-initiated, and you control permissions through your device settings.
12. INTELLECTUAL PROPERTY AND DATA
12.1 SkillSpot Intellectual Property
The Service and all related intellectual property are owned by Mir Image Creations or its licensors and are protected by law.
12.2 User Data
You retain ownership of content you submit. You grant Mir Image Creations a limited license to process such data solely to operate, secure, and improve the Service.
12.3 Aggregated and Derived Data
Mir Image Creations may create and use aggregated, de-identified, or statistical data derived from use of the Service for analytics, security, and product improvement purposes.
12.4 Feedback
If you provide feedback or suggestions, you grant Mir Image Creations a perpetual, royalty-free right to use them without compensation.
13. THIRD-PARTY SERVICES
The Service may integrate with or link to third-party services. We are not responsible for third-party services, content, or practices, which are governed by their own terms and policies.
14. TERMINATION
You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms, legal requirements, security concerns, or operational reasons. Inactive accounts may be suspended or deleted as permitted by law.
15. DISCLAIMER OF WARRANTIES
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Mir Image Creations shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of data, profits, revenue, or goodwill.
Our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) $100 USD or (b) the amounts you paid for the Service in the twelve (12) months preceding the claim.
17. INDEMNIFICATION
You agree to indemnify and hold harmless Mir Image Creations from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.
18. INTERNATIONAL USE AND EXPORT CONTROLS
You represent that you are not located in a jurisdiction where use of the Service is prohibited and that you will comply with applicable export control and sanctions laws. We may restrict availability where required by law.
19. GOVERNING LAW AND CONSUMER RIGHTS
These Terms are governed by the laws of the United States and the jurisdiction in which Mir Image Creations is organized, without regard to conflict-of-law principles.
Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.
20. DISPUTE RESOLUTION; ARBITRATION (U.S.)
For users residing in the United States, disputes arising out of or relating to the Service shall be resolved by binding arbitration, except for small-claims matters or requests for injunctive relief related to intellectual property or unauthorized access.
You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@skillspotapp.com with the subject line “Arbitration Opt-Out.”
Where arbitration is not enforceable, disputes may be brought in the appropriate courts as required by law.
21. COPYRIGHT (DMCA)
If you believe content on the Service infringes copyright, you may submit a notice to legal@skillspotapp.com with the information required by law. We may terminate repeat infringers.
22. MISCELLANEOUS
- Severability: If any provision is unenforceable, the remainder remains in effect.
- No Waiver: Failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without consent; we may assign in a business transfer.
- Equitable Relief: Breach of intellectual property or security obligations may cause irreparable harm.
- Language: The English version controls.
- Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and Mir Image Creations.
